December 2016 Chapter Meeting

Annual Legal Update

Program Topic:   Employment Law & Regulations and Employee & Labor Relations

Program Description:

Each year, employment laws change at a very rapid rate. We will hold our annual legal up date at our December Chapter Meeting. This update, presented by prominent Jacksonville employment law attorneys, regularly enjoys a large crowd, and provides SHRM Jacksonville members and guests with much needed analysis and interpretation of the current legal and legislative climate. This year, our topics include:

The New “Smart” Form I-9 is here - Are you ready?

Presented by Giselle Carson of Marks Gray, P.A.

Immigration law is one of the most prominent legal issues in the United States at this time. Employers across all industries and of all sizes are affected. More than ever before, businesses are having a difficult time keeping up with the most current information concerning immigration regulations, including employment verification and Form I-9 changes.

Ever since the current version of the Form I-9 expired on March 31, 2016, employers have been waiting for the release of the new “smart” Form I-9. The form has just been released and employers will have until January 21, 2017 to plan the internal rollout of the form, train the staff, implement a new I-9 process and update policies and procedures.

In this informative presentation, you’ll get the information you need about the new Form I-9 and its requirements, tips to decrease fines and reduce errors and mistakes, and highlights of key recent court decisions to ensure your organization is in compliance.

Joint Employer Status and Protected Concerted Activity - Discovering Employees You Never Thought You Had and They Can Curse If They Want To . . .

Presented by Robert Devine of Holland & Knight

No federal agency flexed its muscle in the pat eight years more than the National Labor Relations Board. From creating the vast expansion of the definition of employers being a joint employer, to allowing employees to use profanity in the workplace if they are complaining about working conditions. And if you think the NLRB only applies to unionized environments. Think again.

Update on Changes to the EEOC’s Position Statement Procedures

Presented by B. Tyler White of jackson | lewis P.C. (speaker change)

The Equal Employment Opportunity Commission has issued its first-ever nationwide procedures on respondent position statements and guidance on effective position statements. These procedures, along with the EEOC’s Digital Charge system, make significant changes in some jurisdictions, while formalizing the existing practices in others.  Learn how your organization can develop best practices to comply with these changes.

Employment Regulation in the Trump Administration

Presented by Bob McCormack of Ogletree Deakins

What we, as HR Professionals might be expect to come from Congress, The Supreme Court and the Executive Agencies in the upcoming administration as it relates to regulation of employment and labor policy.
